This is a class action on behalf of all non-exempt employees who are or were employed by PGD, on oil rigs in California, at any time from March 8, 2003 through the present.  The Complaint alleges that PGD failed to provide full and correct pay for all hours worked, including first and second meal periods worked.

June 14, 2010:

May 26, 2010:
Hearing on Plaintiffs' Motion for Final Approval of the Settlement Agreement scheduled.  Continued by the Court until June 14, 2010.

May 20, 2010:
Hearing on Plaintiffs' Motion for Final Approval of the Settlement Agreement scheduled.  Continued by the Court until May 26, 2010.

May 11, 2010:
Hearing on Defendant's Motion to Reform the Settlement Agreement scheduled.  Motion denied.

March 24, 2010:
Deadline for Class Members to file a claim, to opt-out, or to object to the Class Action Settlement.

February 22, 2010:
Claim Forms and Opt-Out Forms mailed to Class Members.

December 15, 2009:
Hearing on Plaintiffs' Motion for Preliminary Approval of the Class Action Settlement.  Motion granted.

September 30, 2009:
The parties attended a mediation where the terms of a Settlement were agreed upon.

February 20, 2009:
Deadline for class members to opt-out of class.

February 17, 2009:
Hearing on Defendant's Motion for Clarification of the Court's November 19, 2008 Order and Allowing Defendant Further Briefing Regarding the Order.  Defendant's Motion denied.

January 20, 2009:
Notice of Certification of Class sent to class members.

December 30, 2008:
Defendant's Motion for Clarification of the Court's November 19, 2008 Order and Allowing Defendant Further Briefing Regarding the Order filed.

November 19, 2008:
The Court issued an Order granting Plaintiff's Motion for Certification.

September 30, 2008:
Hearing on the Merits of the Claims of the Putative Class and Continued Hearing on Plaintiff’s Motion to Preliminarily Certify the Class.

June 25, 2008:
Plaintiff’s Briefing Re: the Merits of the Claims of the Putative Class filed.

June 13, 2008:
Court’s Order After Hearing Continuing Motion to Preliminarily Certify the Class. The court continued the hearing on Plaintiff’s Motion to Preliminarily Certify the Class until September 18, 2008 and held that it will decide the merits of the class claims prior to ruling on the motion to preliminarily certify the class. Specifically, Defendant asserts that it is not required to provide meal periods as required by the California Labor Code and IWC Wage Order No. 16-2001 because doing so would create an unsafe work environment in violation of Cal/OSHA.
