This is a class action on behalf of all non-exempt employees who are or were employed by Searles Valley Minerals Operations, Inc., Searles Valley Minerals, Inc., Nirma, Ltd., Sun Capital Partners, Inc., and Sun Capital Partners Group IV, Inc. (“Defendant”) in California.  The Complaint alleges that Defendants failed to provide class members with meal and rest periods, failed to compensate class members for missed meal periods and wages owed, failed to provide class members with proper wage deduction statements, used intimdating and coercive tactics to influence employee election proceedings, and established an inappropriate alternative workweek schedule for class members.

Mediation scheduled.

May 21, 2009:
The parties stipulated to a second stay of all proceedings until July 20, 2009, so that the parties can attend mediation on July 16, 2009.

April 13, 2009:
The Court entered an Order granting the parties request for a stay of all proceedings for 60 days so that the parties can mediate the case.

March 13, 2009:
Demurrer to Plaintiff's Complaint filed by Defendant.

December 22, 2008:
Complaint filed by Plaintiff.
